VERDICT
Mr. Odinga's lawyer George Oraro and
The Civil Society have said that the re-
tallying of votes shows discrepancies in
the presidential results as declared by
IEBC.Counsel Oraro told the Supreme
Court that Forms 36 contains "grave
errors".He said that the re-tallying shows
there was addition of 6,139 votes and a
subtraction of 12,530 votes when figures
are tallied.He was responding to a report
of the scrutiny of results from 22 polling
stations ordered by Sc.
Lawyer Kethi Kilonzo for Africog said
according to the report,Form 34 were
missing in 10 constituencies i.e Laikipia
West constituencies party agents carrying
the vote recount were unable to verify
the number of votes cast.Ms Kilonzo said
president elect Uhuru got 76,760
votes,yet this could not be verified.She
reiterated that IEBC chairman announces
the final results prematurely.According
to the reports,these are,KILIFI
NORTH,KAPENGURIA,LOIMA,MAGARINI,MATUGA,NAROK
WEST,KURESOI
SOUTH,KIKUYANI,KABONDO
KASIPUL,MWINGI NORTH.However IEBC
said that all forms were available on its
website.Aggregates results of Form 36
registered votes from 75 constituencies
were missing,the report says.For instance
in Mvita constituency there were two
Form 36.In Githunguri the two form 36
indicated different number of vote cast.In
Malava,the form 36 was incomplete.In
rebuttal,IEBC lawyer Mungai,said the
IEBC had responded to the other
discrepancies.He said there were no
mischief at all on the part of IEBC in
conducting the general election.
Consequently,UHURU'Slawyer Fred Ngatia
CONCEDED,there were clerical errors but
maintain this could not affect the final
results.
