AKPORS. THE COMEDIAN
Akpors and his friend Johnny were
caught in Saudi Arabia, sharing a
smuggled barrel of beer.
They were arrested and taken to
the Sheikh's palace for questioning
and judgement.
Johnny lied that Akpors smuggled

Ex-minister and Uhuru’s kin passes on

Former Assistant Minister Arthur Aggrey Ochwada is dead. Ochwada, an in-law to President Uhuru Kenyatta, died at a Kisumu hospital following a long illness.
Ochwada served as MP for Busia Central (present day Funyula) constituency between 1969 and 1974, and was husband to Lucy Nyokabi, a daughter of the President’s half-brother, the late Peter Muigai Kenyatta.
Ochwada’s nephew, Patrick Odongo, said the veteran politician died at the Aga Khan Hospital on Thursday night, while undergoing treatment for ailments including diabetes and high blood pressure. He was aged 87.
A pioneer trade unionist alongside the late flamboyant Justice minister Tom Mboya, Ochwada joined politics in the early 1960s, and was elected the first deputy national treasurer of independence political party Kanu. He rose to become a confidant of founding President Kenyatta, and in the process married Nyokabi as his second wife.
Ochwada was elected to Parliament in 1969 alongside his father in-law, Peter, the first-born son of Mzee Kenyatta. Kenyatta rewarded the two close friends with ministerial positions. Ochwada was appointed assistant minister for Natural Resources and Fisheries.
The late politician served for only one term before being dislodged by Julia Ojiambo and later Ochwada’s own first cousin and ninth vice-president, Moody Awori.
Speaking to The Standard On Saturday, area MP Paul Otuoma regretted Ochwada’s death. Describing him as an independence hero, Otuoma said: “The late veteran politician dedicated his youthful life to the national good and to the people of Busia County.” Otuoma condoled with members of Ochwada’s family.
Ochwada’s nephew, Odongo, said funeral plans are under way. Incidentally, Uhuru was in Nyanza for the funeral of the late Kenya National Union of Teachers Secretary General, David Okuta, when Ochwada died. His body lies at Aga Khan Hospital in Kisumu.
UHURU CABINET REJECTED
President Uhuru Kenyatta and his deputy William Ruto could be forced to drop three names they had nominated for Cabinet secretary positions after the anti-corruption commission raised questions on their integrity.
Sources yesterday said the Ethics and Anti-Corruption Commission (EACC) and the National Intelligence Service (NIS) were uncomfortable with the past records of the nominees who they felt should not be part of the new government.
President Kenyatta and Mr Ruto, who pledged a lean clean government, submitted names of their prospective Cabinet to the two institutions for vetting should they be part of Cabinet.
The institutions found out one nominee has been accused of running down a government institution while another faces corruption allegations.
Vetting
If the President and his deputy are to ignore the recommendations of the EACC and the NIS, there are fears that the three may not survive the scrutiny of the Parliamentary Committee on Appointments or even the House.
President Kenyatta and Mr Ruto are set to announce the Cabinet on Wednesday before forwarding the list to the House for scrutiny and approval.
Friday, Kenya Airways boss Titus Naikuni, who is being touted for a Cabinet position, was forced to deny reports that he had quit the national carrier ahead of the naming of the Cabinet.
“I am still a full-time employee of Kenya Airways. Any information to the contrary is untrue and should be ignored,” he said.
Allies of President Kenyatta and Mr Ruto have said the two will be led by professionalism, performance, and integrity when they name their Cabinet.
Yesterday, interviews with allies of the two leaders said they had decided to overhaul the entire structure of the administration they found in place.

"Working conditions for correspondents working for the revamped K-24 TV is horrible, to say but the least. Since November 2012, many correspondents never received any pay yet they deliver news daily all at our own expense and efforts. “Don’t think of facilitation since u will be dreaming…we do forward our claims every month to the person in charge of correspondent diary, but nothing seem to materialize,” said one correspondent.
When Granton Samboja took control of Mediamax as the CEO, he promised many good things, but they are yet to arrive. Instead, he hired new staff and the old guards in the field, thus denying young
talent a chance to grow.

Let us look at the so called impasse soberly. This is TNA GOVERNMENT, isn't it? JUBILEE is an empty shell, a vehicle which was used to propel TNA to power. TNA will therefore decide who is who and who gets what. You don't want me to repeat that, do you?
But, WILLIAM RUTO is clever and he knows what I am saying very well. He knows that he was swallowed the moment he said TNA tosha. He knows that he as a person (Rift Valley interests not withstanding) is home and dry, satisfied with the Deputy President of the Republic. So, the so called "impasse" in naming the secretaries is therefore meant to show the people of Rift Valley that he is actually "fighting" for their interests and "fighting" for PRE ELECTION AGREEMENT to be honored. UHURU TO VISIT NYANZA
Kisumu County Commissioner Lornah Odera yesterday confirmed the President would attend the funeral of the late Kenya National Union of Teachers (Knut) Secretary General David Okuta Osiany in Tura Village, Nyando, Kisumu County.
Two weeks ago Okuta, 59, died at a Nairobi hospital, where he had been rushed after developing breathing complications at his Rongai home.
Earlier, Okuta’s son Edwin said his father had been admitted to Aga Khan Hospital for three weeks and was discharged following his doctor’s recommendation.
“After a few hours he developed breathing problems and we had to rush him to the hospital,” said Edwin.
Okuta died on arrival at Nairobi Women’s Hospital in Rongai. Nyando legislator Fred Outa and the family’s funeral Committee chairman Cosmas Ong’era told The Standard Uhuru is expected at the home at 10am tomorrow.
“He (Uhuru) will be here for the funeral for about four hours,” Mr Outa said yesterday.
He said Uhuru would not tour development projects in Kisumu County, as was earlier expected.
Others expected at the burial include former Prime Minister Raila Odinga and Knut leaders Wilson Sossion.
Okuta was instrumental in fighting for the rights of teachers. He assumed office as secretary general of the teachers union in mid-2011.
The former Knut secretary General had been out of office since February, serving his retirement leave.

A letter addressed to President Obama that was intercepted after a “suspicious substance” was detected has tested positive for ricin, the same substance found on a letter to Mississippi Senator Roger Wicker yesterday, the Dow Jones news wire is reporting.
In addition, a second letter sent to the U.S. Senate has also tested positive for ricin, according to ABC.
Authorities are said to have a suspect in the case of the letter sent to Wicker—a person who “writes a lot of letters to members,” Sen. Claire McCaskill said today. It’s also worth remembering that there’s a history of ricin false positives that have been used to justify hasty security action.

Ensuring poor students get access to University Education
The world's largest
micro-lending organisation KIVA, has announced that it will set up its
Africa base in Nairobi to strengthen its partnerships and advance
economic opportunity.
The Kenyan office will be
Kiva's first outside the USA, a huge development for a non-profit
organisation that was founded in 2005 to lend capital to the small and
medium enterprise across the world aimed at alleviating poverty. Matt
Flannery and Premal Shah who are the founders of the organisation said
the regional office will be based at the Business Centre at
Strathmore University on April 17 this year.
"As
we open the doors to our new office Nairobi, we are opening the door
for new opportunities and exciting partnerships across Africa,'' said
Matt Flannery, CEO and co-founder of Kiva. He added that Nairobi is an
emerging hub for numerous potential social enterprise buoyed by the
entrepreneurial spirit that is hugely nurtured in the country.
Kiva's
borrowers use internet connection and can access loans from as little
as Sh2, 117 ($25) with a repayment rate of 98.9 per cent, lenders are
privileged to relend their money or withdraw it from the system.
Kiva
has 900,000 lenders and has so far distributed more than $410 million
loans to one million people worldwide. In Kenya, the organisation has
previously offered a total of $20.5 million to 63,000 individuals.
The organisation mostly relies on grant from its 250,000 partners from 125 countries globally.
"Fundamentally, Kiva is about recognising and supporting the
potential of small enterprise and ideas to people across the globe
with financial constraints,'' said Premal Shal, Kiva Co-founder and
president.
Kiva micro-loans target
borrowers investing in business, education, energy products and in
sustainable agricultural practices in the country. In Kenya, the
organisation has 14 partners.
Strathmore
University is one of the key beneficiaries of this initiative, under
their flexible, risk tolerant capital, Strathmore University students
who comes from the poor background has accessed 11-year tuition loan
that comes with a five year grace period.
Lydia Balil is one of the recipients of the education scheme under
Kiva who is studying for a Bachelor of Commerce at the University.
Being raised up in Turkana County in the remote area of Northern
Kenya, her hopes for higher education were almost dashed off were it
not for the financial support she received from the latter.
"My
past experience almost compromised my education, given this chance by
Kiva, my quest for higher education can now be achieved,'' she said.
Kiva
key partner, Juhundi Kilimo has so far provided financial services to
over 7,000 small scale farmers in the rural areas of Kenya where
majority of the recipients are women.
Juhundi
mission is to provide wealth creating financial services including
conducive loans to acquire productive assets such as dairy cows and
irrigation schemes.
Another partner
identified by the name Komanza, helps the borrowers convert dry lands
into productive and meaningful tree farms in the Eastern Kenya.
In
May 2011, Kiva began a new lending channel dubbed ‘'Kiva Green
Loans'' that target enterprises reducing energy consumption by coming
up with new models of conserving waste and pollution by recycling
used materials towards alleviating energy poverty and maintaining a
healthy environment.
It is estimated that
1.5 billion people which is a quarter of the world's population do not
have access to electricity where the only source of energy comes from
costly and polluting products like charcoal and kerosene.
Kiva
started its operation with only five employees with a total of $
3,500 in funded loans. Today, it boasts to a huge global community of
850,000 members giving out $1.5 million in loans per week.
Kiva
borrows its name from East Africa where its founders initially worked
in Uganda and Kenya. In Uganda, Kiva is a colloquial word for unity.
Uhuru hosts Raila, Kalonzo
The government Saturday held talks with CORD leaders at State House, Nairobi
Coalition for Reforms and Democracy (CORD) leaders Raila Odinga and Kalonzo Musyoka met and held talks with President Uhuru Kenyatta and Deputy President William Ruto.
The Saturday meeting focused on the upcoming State Opening of the 11th Parliament, which the two CORD leaders promised to attend.
The leaders also discussed modalities for a bipartisan approach to issues in Parliament, the leadership of critical House Committees and the role of the minority party.

Coalition for Reforms and Democracy (CORD) leaders Raila Odinga and Kalonzo Musyoka met and held talks with President Uhuru Kenyatta and Deputy President William Ruto.
The Saturday meeting focused on the upcoming State Opening of the 11th Parliament, which the two CORD leaders promised to attend.
The leaders also discussed modalities for a bipartisan approach to issues in Parliament, the leadership of critical House Committees and the role of the minority party.

The wife of William Oduol (Siaya Gubernatorial race candidate) is going through a lot. Her name is Nancy Dayo. She is now jobless after she exhausted all her sick leave with her employer. She has been assaulted by the husband it seems she cannot get justice from anywhere else.Here are pics of her assault.
She has failed to get justice from the courts because William Oduol has all the money to bribe everyone he want to. The worst bit is that despite William being in and out of courts with domestic violence cases since 2001, he is a licensed gun holder. He recently went to his wife’s residence (they are now separated) to threaten her and brag that she cannot get justice from the courts.

- This brings me to the second reason why Mr Kenyatta emerged “victorious”. He was able to cobble together a large collection of tribal voters while “dispersing” some critical Cord strongholds, most principally the Luhya.inShare
On September 17, 2008, Judge Johann Kriegler,
the chair of the Independent Review Commission, concluded that the 2007
elections were so “materially defective” that no one could know who won
them.
In contrast, CJ Willy Mutunga declared on March
30, 2013, that this year’s presidential elections were “free, fair, and
transparent”. That’s the “legal opinion” of a “unanimous” Supreme Court.
But a “legal opinion” and “material reality” could
differ. Even though most people have accepted the court’s ruling, a
large number are using Judge Kriegler’s words to describe this year’s
election — they are unconvinced the election wasn’t “materially
defective”.
That’s called freedom of thought and conscience. But there’s a bigger question. Why did the Kenyattas top the Odingas — again?
Scholars will forever debate whether Jubilee
flag-bearer Uhuru Kenyatta won the election, or Cord’s Raila Odinga lost
it. I am convinced we’ll never know the truth. That’s because the
Supreme Court’s judgment is final, and there’s no opportunity for
further review.
In reality, this leaves the country divided down
the middle. Whether President-elect Kenyatta can overcome this chasm
remains to be seen. His predecessor, President Mwai Kibaki, never
overcame the illegitimacy of the 2007 elections.
But no matter where you fall on the political
divide, you must ponder what Mr Kenyatta’s “defeat” of Mr Odinga means
for Kenya. Tribal jingoism and chest-thumbing can’t wish this pivotal
question away. These two key protagonists represent more than their
individual selves.
There are four reasons Mr Kenyatta “vanquished” Mr
Odinga. The first reason is simply who controls the State. This is a
historical matter. Some have argued, incorrectly, that both Mr Odinga
and Mr Kenyatta belong to the same political class. I say baloney.
Mr Kenyatta is a bona fide “insider” while Mr
Odinga is an “outcast” and an “outsider”. Mr Kenyatta belongs to the
faction of the ruling elite that’s always controlled the Kenyan state.
Mr Odinga has led an elite that’s always knocked
on the door, only to be turned away at every turn. Even as Prime
Minister, the closest he’s ever come to the inner sanctum of power, Mr
Odinga was relegated to the margins.
It’s true Mr Kibaki and State House mandarins may
have tried to stop Mr Kenyatta from succeeding him, but he outsmarted
them. Mr Kibaki’s aides thought Mr Kenyatta woes at The Hague wouldn’t
be good for business.
Nor did the optics of one Kikuyu succeeding
another look attractive. Word was that State House fronted UDF leader
Musalia Mudavadi as a “safe pair of hands”.
That term simply meant someone who wouldn’t
disrupt the status quo. That’s because Mr Mudavadi — though Luhya — is a
true insider. By birth and ideology, he’s part of the multi-tribal
elite that’s run the Kenyan state since independence.
But Mr Kenyatta cannibalised Mr Mudavadi’s
candidacy through chicanery and skullduggery. He outfoxed Mr Kibaki’s
aides. In the end, Mr Mudavadi’s lone entry into the race ate into Mr
Odinga’s support among the Luhya.
This brings me to the second reason why Mr
Kenyatta emerged “victorious”. He was able to cobble together a large
collection of tribal voters while “dispersing” some critical Cord
strongholds, most principally the Luhya.
The tribe remains king in Kenya’s electoral map.
The Big Five — the main ethnic groups that make up 70 per cent of
Kenya’s population — determine presidential elections.
I doubt Mr Kenyatta reached the required 50 per
cent plus one vote to win outright — given the irregularities adduced at
the Supreme Court — but I think he assembled enough tribal votes for a
run-off. That wouldn’t have been possible but for the tribe.
The third reason for Mr Odinga’s “defeat” is
“patronage” and “patrimony”. The Odingas and the Kenyattas come from
different worlds. The Kenyattas — according to public records and Forbes
magazine — are one of Africa’s wealthiest families.

Uhuru Kenyatta was sworn in as Kenya's fourth
president on Tuesday to thunderous cheers from tens of thousands of
supporters, despite facing trial on charges of crimes against humanity.
"I do swear that I will be faithful and bear true
allegiance to the Republic of Kenya," said Kenyatta, the son of the
country's first president, clutching a bible as he took the oath of
office.
Wearing a dark suit and red tie, he also pledged
to "protect and uphold, the sovereignty, integrity and dignity of the
people of Kenya".
Officials had to appeal for quiet as 60,000 people
packed into Kenya's national football stadium chanted Kenyatta's name
and roared in support as they danced.
William Ruto, who like Kenyatta faces trial at the
International Criminal Court (ICC) for crimes against humanity related
to post-election violence five years ago, took the oath of office as
vice-president.
"I will always truly and diligently serve the
people and the Republic of Kenya in the office of the deputy president,"
Ruto said.
"I will do justice to all without fear, favour, affection and ill will," he added.
Kenyatta, one of Africa's richest men, won the
March 4 polls by more than 800,000 votes ahead of his nearest rival,
outgoing Prime Minister Raila Odinga.
The 51-year-old is Kenya's youngest president.
Security was heavy as Kenyatta loyalists, dressed
in the red colours of the winning Jubilee Coalition party, waved and
military bands played tunes to welcome the new leader and bid farewell
to outgoing President Mwai Kibaki, 81, retiring after more than a decade
in power.
Kibaki handed over Kenya's symbols of power -- a
sword and the constitution -- to Kenyatta, with both smiling broadly and
shaking hands. The handover was followed by a booming 21-gun salute.
Regional leaders and foreign diplomats watched as
the full to capacity stadium danced and sang along to music and a
military parade.
Among the heads of state attending the ceremony
were Ethiopia's Hailemariam Desalegn, Somalia's Hassan Sheikh Mohamud,
South Sudan's Salva Kiir, Tanzania's Jakaya Kikwete and Uganda's Yoweri
Museveni.
Odinga, who failed in his court bid to overturn Kenyatta's victory, did not attend.
Western nations, many of which have a policy of only "essential contact" with ICC indictees, sent ambassadors to the ceremony.
Many supporters packed in buses arrived long
before dawn from central Kenya and the Rift Valley, strong support bases
of Kenyatta and Ruho.
"This is a great day," 23-year-old student Martin
Munyua told AFP. "People thought Uhuru could not be president but we
showed them that we believe in him. This is our day to celebrate."
"We have come to welcome our new sons to the State
House," said 35-year old high school teacher Jairus Koech, who
travelled all night from the Rift Valley town of Eldoret to attend the
celebrations.

Friday April 5,2013 - Outgoing Prime Minister Raila Odinga has started
clearing out from the former Shell and BP House, 3 days before the
Tuesday next week deadline.
According to Raila’s close aide, the PM is also finalising matters with
government institutions before retiring to his home in Bondo.
Head of Public Services Francis Kimemia had directed Raila that he hands
over before Tuesday’s swearing in of Uhuru Kenyatta as the country’s
fourth President.
“What I can tell you for now is that the PM
is doing the necessary exit clearance with the relevant Government
offices such as Parliament among others,” the official said.
Raila will hand over offices and other assets to the Public Service Commission for auditing.
Raila will also lose the State Security since from Tuesday next week and he will be a normal civilian like majority of Kenyans.
The PM will also lose five vehicles that were assigned to him plus security for his spouse, Mama Ida Odinga.
Raila will also miss out the retirement perks unless the Bill is reintroduced in the current parliament.

Duties and Responsibilities:
The County Executive Committee members shall be responsible to the Governor and their duties will entail the following:
- Delivery of services in the respective departments and all decentralized units and agencies within the department.
- Provide the county assembly with regular reports regarding the departments.
- Facilitate the co-ordination and alignment of integrated development plans of their respective departments within the county.
- Implement national and county legislation.
- Advice the Governor on matters relating to their respective areas of jurisdiction.

Duties and Responsibilities:
- Establish and abolish offices in the County Public Service.
- Confirm appointments and exercise disciplinary control over County Public Service employees.
- Prepare regular reports for submission to the County Assembly on execution of board functions.
- Appoint persons to hold or act in offices of the county public service including town committees within the county.
- Promote in the county public service the values and principles referred to in Articles 10 and 232 of the constitution.
- Evaluate and report to the County Assembly the extent to which the values and principles referred to in Articles 10 and 232 of the Constitution are complied with in the County Public Service.
- Facilitate the development of coherent, integrated human resource planning and budgeting for personnel emoluments in the county
- Advice the county government on human resource management and development
- Advise county governments in implementation and monitoring of the national performance management system in counties.
- Make recommendations to the Salaries and Remuneration Commission, on behalf of the County Government, on the remuneration, pensions and gratuities for county public service employees
Requirements:
To qualify, one must:
- Be a Kenyan citizen
- Possess a minimum qualification of a bachelors’ degree from a recognized university.
- Working experience in a leadership position of not less than five years for the Secretary and Board members, and ten years for the Chairperson.
- Be professional, with demonstrated absence of breach of the relevant professional code of conduct.
- Satisfy the provision of chapter six of the constitution.
- Understand diversity within the county.
- Be visionary and possess good leadership qualities.
- Be able to work under pressure to meet deadlines.
- The candidates for the post of Secretary must be a Certified Public Secretary.
- Qualifications in strategic management will be an added advantage for the candidates seeking to fill the post of Board Chairperson.

- The Chairperson and members of the County Public Service Board will serve on part-time basis on a nonrenewable contract period of six (6) years.
- The Board Secretary will serve on a full- time basis for a non- renewable contract period of six (6) years.

Ni la kuwatawala na kuwagandamiza wale wanaoishi kwa kutegemea ujira, wavujajasho, wakodeshaji nyumba, wale ambao ni mafukara ama walalahoi. Kwa ujanja wake, ambao ni pamoja na kujificha ndani ya katiba na demokrasi ya kibepari, dola la kibepari linaonekana kana kwamba liko kwa ajili ya taifa na kila raia pasina mapendeleo. Bali haijawezakana wala haitawezekana kuwa na usawa kati ya tajiri na maskini. Usawa huo unawezekana tu katika maandishi ya katiba wala siyo katika hali halisi ya maisha.
Kama kawaida ya katiba zote za kibepari, ruwaza ya katiba ya Kitonga imejaa orodha ya haki za binadamu, kama usawa katika sheria, uhuru wa kusema na kusambaza maoni, uhuru wa kutembea na kujumuika, haki ya matibabu, haki ya kujipatia riziki, haki ya kuwa na nyumba bora, haki ya elimu kwa kila raia, haki ya kuchagua au kuchaguliwa kiongozi, haki za wafanyikazi, haki za watoto, haki za wanawake, haki za walemavu na haki za wazee. Sawa, lakini wakati huohuo ruwaza ya katiba inalinda mali ya binafsi ambayo ni msingi wa ubepari. Inaahidi haki na usawa kwa raia wote ndani ya mfumo wa kitabaka, jambo la kuwavisha vilemba vya ukoka wengi ambao ni mafukara na wanaolilia ukombozi.
Msingi wa katiba za kibepari ni kulinda na kuabudu haki ya mtaji na mali ya binafsi. Kwa mfano, mabepari wana haki ya kuwa na mali ya binafsi na kuikuza kwa vyovyote vile hata kwa kuwanyonya na kuwanyanyasa wafanyikazi katika viwanda, makarakana, makampuni, na popote pale penye mitaji yao. Nao mafukara eti wanahakikishiwa na katiba haki ya kuwa mabepari wakitaka. Lakini, utake usitake bila mtaji huwezi kuwa bepari. Huwezi kutoka kwa tabaka la wafanyikazi na kuingia tabaka la mabepari ghafla bin vu ati kwa kuwa tu umeamua kufanya hivyo au kwa sababu unaruhusiwa na katiba. Ukweli ni kuwa uwezo wa mtu kutoka tabaka la mafukara kuingia tabaka la mabepari ni sawa na ule wa ngamia kupitia tundu la sindano.
Tukiangazia Kenya tunaona kuwa jamaa za matajiri, zenye kudhibiti uchumi wa pesa, ardhi, biashara na mali tilatila, ni zilezile tu za kutoka kale na zamani. Aidha, pengo kati ya matajiri na maskini linazidi kupanuka nchini kila siku. Chimbuko cha umaskini si kuwa maskini hawafanyi kazi kwa bidii bali ni mfumo unaohakikisha kuwa kazi na bidii ya maskini inamfaidi tajiri badala ya yeye mwenyewe. Asili ya utajiri wa tajiri si kazi na bidii ya tajiri bali ni umilikaji wa njia ya uzalishaji inayomwezesha kuwanyonya wafanyikazi. Kujigamba kuwa umepanda kutoka biashara ya makaa na kuwa bilionea wa pesa, biashara, ardhi, majumba na mali tilatila leo kutokana na bidii zako binafsi, ni kutupigia hekaya za Abunwasi.
Ruwaza ya katiba mpya imewapa wananchi wote haki za matibabu. Lakini kadiri ambapo Kenya itandelea kuwa ya ubepari, matajiri ndiyo watakaondelea kutekeleza haki hii mara nyingi zaidi kuwaliko makabwela na mafukara. Nchini leo, udaktari, mahosipitali na matibabu ni biashara kama biashara yoyote ile inayowatajirisha watu binafsi kwa kuwanyonya wagonjwa. Bila pesa ni muhali kupata matibabu yoyote, sembuse matibabu bora. Adili za udaktari, ambazo ni pamoja na kujitahidi wakati wote kuokoa maisha, hazitekelezwi katika mfumo unaoongozwa na adili ya kuchuma mali kwa vyovyote vile. Wala hakuna huruma, pesa zimekuwa na thamani kuliko maisha Kenya. Udaktari kama utaalamu wowote ule unatumiwa kuendeleza mfumo wa unyonyaji wa mtu kwa mtu.
Elimu pia imekuwa bidhaa kama bidhaa yoyote ile. Wenye hela ndiyo wenye uwezo wa kuwanunulia watoto wao elimu bora zaidi katika shule za binafsi nchini na ughaibuni. Elimu Kenya inatumiwa maksuudi kuzidisha na kuhifadhi utabaka na pengo kati ya matajiri na maskini. Na serikali haina haya wala aibu kuendeleza mfumo wa elimu unaowabagua, kuwakebehi na kuwanyanyasa watoto wa makabwela. Maana ni serikali ya mabepari.
Ndiyo, katiba mpaya ije. Bali tutumie muda wetu zaidi kuangazia mfumo wa kujamii – kiuchumi maana tusipoubadilisha na kuleta mpya na wa hali ya juu zaidi punde tutagundua kuwa katiba mpya vilevile ni mbio za sakafuni.
Challenging Uhuru Kenyatta as “Richest Person in Kenya”
Forbes classification criteria questioned; Uhuru’s wealth is stolen wealth
Forbes Magazine recently published a list of Africa’s 40 richest persons with Uhuru Kenyatta ranked 26th and number one richest person in Kenya. His net worth is an estimated $500 million, which translates to almost 50 billion Kenyan Shillings.This is how Forbes described his wealth: “Kenya’s Deputy Prime Minister Uhuru Kenyatta is the son of Kenya’s first president, Jomo Kenyatta, and heir to some of the largest land holdings in Kenya. He owns at least 500,000 acres of prime land spread across the country. The land was acquired by his father in the 1960s and 1970s when the British colonial government and the World Bank funded a settlement transfer fund scheme that enabled government officials and wealthy Kenyans to acquire land from the British at very low prices. Uhuru and his family also own Brookside Dairies, Kenya’s largest dairy company, as well as stakes in popular television station K24 and a commercial bank in Nairobi, among other interests.”
In a WikiLeaks cable dated June 26th 2009, former US ambassador to Kenya Michael Ranneberger described Uhuru’s wealth this way: “Although his wealth is the inheritance from his father’s corruption, the Kenyatta family still holds a special status”. Yet another description from veteran Kenyan journalist and lecturer Joe Kadhi on his blog ‘Msemakweli’ goes: “Among the haves, Uhuru represents the pinnacle of cornucopia. He has wealth he hardly worked for. Wealth that was acquired by his father through the use of despotic powers. All this, when children of true freedom fighters are languishing in indescribable poverty, caused by the exploitation by the very people who opposed the fight for independence.”
Did Forbes investigate the origins of Uhuru Kenyatta’s wealth? According to the magazine, it does not include political leaders on its list of the richest because it is not easy to calculate how they have generated their wealth. Ironically, Uhuru is a Member of Parliament for Gatundu South, Leader of KANU Party and Deputy Prime Minister. Information on its website notes that: “Forbes has long separated rulers and dictators from our annual rankings of the World’s Billionaires, distinguishing between personal, entrepreneurial wealth and wealth derived largely from positions of power, where lines often blur between what is owned by the country and what is owned by the individual.” How many generations does it take to “clean” allegedly ill-begotten wealth?
Since Uhuru is now on the Forbes list, Moi’s son Gideon should be considered at a certain point because his father was also president, yet gathered wealth unscrupulously as noted in the Kroll Report commissioned by president Kibaki in 2003 and submitted in 2004. It is alleged that Moi and his relatives “siphoned off more than £1bn+ of government money.” Gideon Moi was then worth £550m.
Kenyatta: The biggest land grabber in Kenyan history
The naming of Uhuru as Kenya’s richest man generated mixed reactions from Kenyans in the social media. Many felt that his father Jomo Kenyatta, used his position as president to grab land and accumulate enormous wealth. There are documents indicating that Jomo Kenyatta acquired land through resettlement schemes organized by the then British government and the World Bank. Uhuru Kenyatta has mentioned in the past that his wealth belongs to the “Kenyatta family”. In November 2010, the online business magazine “Africa Investor” wrote that Uhuru had estimated his family’s wealth at $10 billion.
“The Star” Journalist Who was Investigating Fertilizer Scandal Found Dead in His House
Nairobi, April 1, 2013–A correspondent for The Star daily newspaper was found dead Sunday morning in his house in the coastal city of Mombasa, local journalists told CPJ. A housemate found reporter Bernard Wesonga with blood on his nose and mouth at around 11:30 a.m., Star Deputy Editor Charles Kerich said.Local journalists said Wesonga, 27, was with friends at a local pub in Mombasa Saturday night, leaving around 10 p.m. Wesonga had told friends he recently received anonymous threats via text message in connection with a story that described allegations of unlawful shipment and sale of fertilizer that had exceeded its expiration date, journalists said.
Authorities have not established a cause of death. Aggrey Adoli, the head of provincial police, told reporters that a coroner’s report would be released Wednesday.
“We offer our deep condolences to Bernard Wesonga’s family and colleagues, and urge the authorities to investigate his death thoroughly,” CPJ East Africa Consultant Tom Rhodes said.
Wesonga’s immediate supervisor, Chief Correspondent Maureen Mudi, described the victim as a hard-working reporter who had “a lot of potential and never disappointed” in his coverage. She said Wesonga had worked for the paper for a year and had undertaken several investigative stories, including a piece about illegal importation of cars.
Kenyan reporters regularly face threats and attacks, according to CPJ research, although homicides are rare. CPJ has documented one case of a Kenyan journalist killed in retaliation for his work. Francis Nyaruri, a reporter for the Weekly Citizen, was brutally murdered in western Kenya in January 2009 while investigating suspected corruption in a police construction project. The investigation has not yielded arrests.
LSK Statement on Supreme Court Ruling on Raila Odinga’s Petition
TECHNICALITIES VIS-À-VIS SUBSTANTIVE JUSTICE: IMPACT OF THE SUPREME COURT RULING ON THE PRACTICE OF LAW“The Constitution guarantees equal protection of the law for everyone .It therefore demands that justice must be done to all irrespective of status .It also demands that all state organs must assure access to justice for all persons.—.These twin constitutional demands—require that justice be delivered expeditiously and without undue regard to technicalities.—.In particular the judiciary shall leverage and build on the new Supreme Court established by the constitution to engage in progressive jurisprudence conscious of and faithful to the constitutional basis of its origins and mandate.” An extract from the Key Result Areas (under Pillar one and two) of The Judiciary Transformation Framework 2012-2016.
Doubts abound whether given its recent ruling, which struck out a further affidavit in Presidential Election Petition No.5 of 2013, the Supreme Court was keeping to the policy of the new judiciary as per the above transformation framework. On the 25th March 2013 the respondents in the aforesaid presidential election petition asked the Supreme Court to strike out a further affidavit filed by the petitioner on the grounds that the said affidavit had been filed out of time and without leave of the court. The petitioners on their part resisted that attempt on grounds inter alia that the constitution dictates that the judiciary should undertake its mandate without due regard to procedural technicalities.
In its ruling delivered on 26th March 2013 the Supreme Court struck out the further affidavit by the petitioner by holding, among others, that leave ought to have been sought before the affidavit was filed. It further stated that the interpretation of Article 159(2) (d) of the constitution on “undue regard to technicalities” did not mean that procedural technicalities imposed by either the constitution or written law may be ignored.
What does this ruling by the Supreme Court portent to the practice of law in our country? Since the promulgation of the constitution and the advent of the new Civil Procedure Act and Rules and the Court of Appeal Rules (oxygen rule) the practice of law in Kenya has evolved from adherence to procedural technicalities to emphasize on substantive justice. Indeed the new judiciary has generally adopted an approach which abhors technicalities in dispensation of justice. The Honourable the Chief Justice and President of The Supreme Court Hon. Justice Willy Mutunga has time and again reminded lawyers that the era of reliance on procedural technicalities is gone. This position is also fortified by the Supreme Court Act, the Supreme Court Rules and the The Constitution of Kenya (Protection of Rights and Fundamental Freedoms and Enforcement of The Constitution) Practice and Procedure Rules 2012. The foregoing procedural legislation places heavy premium on substantive justice as opposed to procedural technicalities.
A look at recent judicial pronouncements from the Court of Appeal, the High Court and subordinate courts tells you that the judiciary has come of age by embracing the constitutional requirement on substance as provided for under Article 159 of the constitution. There are many decisions from our courts on this issue but let me share one such decision. In Equity Bank Limited v Capital Construction Limited [2012] eKLR the Hon.Mr.Justice Musinga (as he then was) expressed himself in this manner; “While the submission may be right in law, I do not think that in the new constitutional dispensation it can be a ground for dismissing an application for review that is otherwise merited. I say so because Article 159(2)(d) of the constitution of Kenya 2010 requires the court to administer justice without undue regard to procedural technicalities.—.The inclusion of such a provision was very deliberate and I believe it was informed by public outcry regarding serious injustices that were occasioned to litigants due to the judiciary’s rigid observance of procedural technicalities—.If courts continue to accord procedural technicalities undue prominence in administration of justice they will be negating an important constitutional requirement.”
These progressive jurisprudential gains are likely to be upset by this precedence from the highest court in the land. The doctrine of stare decisis (with regard to decisions from the Supreme Court) is now entrenched in our constitution in Article 163(7) which provides that “all courts, other than the supreme court, are bound by the decisions of the supreme court. ” This therefore means that any court which disregards this decision by the Supreme Court or attempts to interpret the said decision with a view to distinguishing it may be in breach of the constitution. I see some lawyers taking advantage of this decision to take us back to the era of litigating by way of advancing argument of a technical nature. This kind of practice had been amplified and perfected by the then Court of Appeal and the then Milimani Commercial Division of the High Court, Nairobi.
This unfortunate situation may be salvaged if the Supreme Court clarifies its decision or places a rider in respect of the context in which it pronounced itself. In the meantime and in order to promote the good practice of law I urge our members to exercise “bar restraint” in citing this decision from the Supreme Court. The bar remains “on trial” as to how it will interpret and apply this decision.
